Is kratom legal in Florida?

The three layers

Federal: the August 2026 scheduling covered concentrated 7-OH (7-hydroxymitragynine) above a set threshold. It did not cover kratom leaf or its naturally occurring mitragynine. That is the same everywhere in the country, so every hard question about Florida is really about the next two layers.

State: Florida’s Kratom Consumer Protection Act makes it unlawful to sell, deliver, or ship kratom to anyone under 21, and requires retailers to verify age with a government-issued photo ID. Separately, the Attorney General’s emergency rule — first issued in 2026 and expanded on June 22, 2026 — schedules concentrated 7-OH and six related compounds: no product may contain more than 1 milligram of them per gram or milliliter, and any product containing them must carry at least a hundred times more natural mitragynine by mass. Plain kratom leaf at natural alkaloid levels is not affected. The state reports pulling more than 23,000 products from shelves under that rule.

Local: Sarasota County bans kratom by local ordinance. Everywhere else in Florida, the state rules apply — but check your own county.
