The three layers
Federal: the August 2026 scheduling covered concentrated 7-OH (7-hydroxymitragynine) above a set threshold. It did not cover kratom leaf or its naturally occurring mitragynine. That is the same everywhere in the country, so every hard question about Indiana is really about the next two layers.
State: Indiana has treated kratom as a Schedule I controlled substance since 2014, when Senate Bill 305 listed mitragynine and 7-hydroxymitragynine as synthetic drugs. Possession, sale, and distribution carry criminal penalties. It is one of the longest-standing state bans in the country.
Local: With a statewide ban in force, the state law applies everywhere in Indiana.
What’s moving: House Bill 1500, filed in January 2023, would have decriminalized and regulated kratom. It never left committee. No repeal effort had advanced as of our check.
