Is kratom legal in Nevada?

The three layers

Federal: the August 2026 scheduling covered concentrated 7-OH (7-hydroxymitragynine) above a set threshold. It did not cover kratom leaf or its naturally occurring mitragynine. That is the same everywhere in the country, so every hard question about Nevada is really about the next two layers.

State: Nevada passed its Kratom Consumer Protection Act in 2019. It requires age verification for buyers 18 and over, purity testing, accurate labeling, and bans synthetic or adulterated kratom products.

Local: Counties can add their own rules on top of the state law. We aren’t aware of a local ban, but check your own county.

What’s moving: Assembly Bill 322 (2025–26 session) would revise how Nevada defines a kratom product. It had not changed the law as of our check.
