The three layers
Federal: the August 2026 scheduling covered concentrated 7-OH (7-hydroxymitragynine) above a set threshold. It did not cover kratom leaf or its naturally occurring mitragynine. That is the same everywhere in the country, so every hard question about Tennessee is really about the next two layers.
State: House Bill 1649, known as Matthew Davenport’s Law, was signed on April 16, 2026 and took effect July 1, 2026. It prohibits possessing, selling, manufacturing, or distributing kratom in any form — leaf, powder, capsules, shots, extracts — and defines kratom to include mitragynine, 7-hydroxymitragynine, and their synthetic equivalents. Knowing possession is a Class A misdemeanor; manufacturing, delivering, or selling is a Class C felony. The bill passed the House 78–9 and the Senate 23–3.
