Is kratom legal in Texas?

The three layers

Federal: the August 2026 scheduling covered concentrated 7-OH (7-hydroxymitragynine) above a set threshold. It did not cover kratom leaf or its naturally occurring mitragynine. That is the same everywhere in the country, so every hard question about Texas is really about the next two layers.

State: Texas regulates kratom through the Texas Kratom Consumer Health and Safety Protection Act, Chapter 444 of the Health and Safety Code, in effect since September 1, 2023. Kratom is not a controlled substance in Texas. The Act bars sales to anyone under 18, requires labeling, and caps how much 7-hydroxymitragynine a product may contain relative to its other alkaloids.

Local: No major Texas city or county has enacted its own kratom ban that we know of, but local rules can appear without much notice — check your own city.

What’s moving: In the 2025 session, Senate Bill 1868 would have added kratom to the Texas Controlled Substances Act. It passed the Senate on April 24, 2025 and died in the House Public Health Committee when the session ended June 2, 2025. The next regular session opens in January 2027.
